THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.3537 of 2015 ORDER:

The petitioner is the plaintiff in O.S.No.2 of 2004. The said suit was filed for perpetual injunction restraining the defendants from interfering with the possession of plaintiff over the suit schedule property in an extent of Ac.1.00 dry land out of Survey No.272, shown as Survey No.272/AA and further shown as Survey No.272/3 in the revenue records situated at Dhanwada Village and Mandal in Mahabubnagar District. The evidence in the said suit was completed. At the stage of arguments, I.A.No.190 of 2015 was filed by the petitioner for appointment of an

Advocate Commissioner to re-fix the boundary stones with the help of Inspector, Survey and Land Records, Mahabubnagar, as per Exs.A3 and A4 exhibited in I.A.No.10 of 2004. The learned Junior Civil Judge, Narayanpet, observing that the petitioner himself deposed that there was a survey prior to the filing of the suit and the boundary stones were fixed in Survey No.272/3 by preparing panchanama and sketch map which were marked as Exs.A3 and A4 in I.A.No.10 of 2004, dismissed the said application by order dated 07.08.2015.

Challenging the same, the present Civil Revision Petition is filed.

This Court feels that the order passed by the lower Court is perfectly in order in the facts and circumstances of the case and there is no material irregularity in the exercise of jurisdiction vested in it. The Civil Revision Petition is, accordingly, dismissed at the admission stage. The miscellaneous petitions pending, if any, shall stand closed.
