THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28870 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the notification dated 09.08.2016 issued by the first respondent to conduct auction on 29.08.2016 and trying to dispossess the petitioners as illegal and arbitrary.

When the matter is taken up for hearing, learned counsel for the petitioners on instructions seeks permission of this court to permit the petitioners to withdraw the writ petition with a liberty to avail the alternative remedy.

Permission as sought for is granted.

Accordingly, this writ petition is dismissed as withdrawn granting liberty to the petitioners to avail the remedies available to them under law. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed.
