THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15871 of 2015 ORDER :

That one Deepthi Sree Co-operative House Building Society purchased land to an extent of Ac.20-18 guntas in Survey No.150 of Hafeezpet Village, Serlingampally Mandal, Ranga Reddy District. The said Society sold Plot No.525/1 admeasuring 150 Square yards forming part of Survey No.150 which was initially purchased by one Sri P. Srinivas Rao, from whom the property changed hands and ultimately the petitioner purchased the same on 12.05.2015.

2. The case of the petitioner is that the previous vendor i.e., M. Sai Lakshmi applied

for building permission which was sanctioned on 11.06.2009, but she could not construct the building as per the permission granted. She constructed only a small watchman room. After the purchase made by the petitioner, when petitioner intend to construct building as per the sanction plan dated 11.06.2009, the 2nd respondentauthorities directed the petitioner to stop construction. No written order was served on her but physically they have been threatening her to face the consequences, if the construction is not stopped by the petitioner.

3. Learned counsel for the petitioner submits that building permission granted on 11.06.2009 would expire shortly and therefore, unless the building is constructed, great prejudice would be caused to her.

As seen from the pleadings from the affidavit and the material filed in support of the writ petition, there is no mention as to who has threatened the petitioner against undertaking of construction work. No such complaint is made to the competent authority against such obstruction. According to the petitioner she has a valid building permission granted, which is in force. If that is so, there is no reason for the petitioner to apprehend nor the consequence of an illegal order of stopping the construction activity and if there was any such illegal order, she ought to have complained to the competent authority.

Having regard to the above, the Writ petition is disposed of at the admission stage, leaving it open to the petitioner to file a detailed representation to the competent authority against the officers who are threatening the petitioner in undertaking construction of Plot No.525/1, in Survey No.150, Deepthi Sree Cooperative House Building Society, Hafeezpet Village, Serlingampally Mandal, Ranga Reddy District. It is needless to observe that as and when such representation is made, the same shall be acted upon by the competent authority as expeditiously as possible, as the alleged building permission granted to the petitioner would expire shortly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J 8th June, 2015 Rds
