(Respondents in-do-) Counsel for the Petitioner : SRI.C.RAJA SEKHAR REDDY Counsel for the Respondents : GP FOR SERVICES-I (TG) Petition under Section l5l CPC praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondenls to consider the case of the petitioner by following the seniority and on the spouse ground in the cadre of Secondary Grade Teacher (Telugu) and effect the transfers in allotting the DistrictsiZones/ Multi-zones in the cadre as per the G.O.Ms.No.317, G.A. (SPF-l) Department, dt:6-12-2021, by passing orders on the spouse appeal dt. 26-12-2021 made by the petitioner to the 3rd respondent, pending disposal of the above WP No.892l of 2022, on the file of the High Court.
The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt ofnotice in the case). OR-DER Heard learned counsel for the petitioner, Iearned Government Pleaders for Services appearing for respondents and perused the record. Petitioner contends that against the allotment order dt.24.12.2021, petitioner had filed appeal to the appropriate authority on 25.12.2021 on spouse ground and the said appeal is pending consideration.
It is further contended that the respondents have issued posting orders in contravention of instructions issued by the Chief Secretary, Government of Telangana, vide Memo dt.24.12.2021, whereunder the authorities have been directed to dispose of spouse category cases relating to allotment ofcadre before issuing posting orders. \--./
& Without expressing any view on the said contention urged, since it is admitted that the petitioner has already availed the remedy as provided under Regulation 27 of guidelines issued under G.O,Ms.No.3l7 General Administration (SPF -I) Department, dt,06,12,2021, pending further orders, the respondents are directed to dispose of the said appeal on or before 08.04.2022 in accordance with law. It is further made clear that while considering the appeal, the respondents shall keep in mind the intent and purport behind the Circular instructions issued vide Memo No.I655/SPF-I/2021-8 dt.24.12.2021 by the Chief Secretary to Government relating to posting of employees in newly allotted cadre under Spouse Category.
