0THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.23895 OF 2000 ORDER:

The learned Counsel for the petitioner submits that this writ petition is filed seeking to issue a mandamus declaring the action of the respondents in not extending the similar benefit that was given to the admitted juniors to the petitioner for promotion to higher categories, as illegal and arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India, and further seeking to direct the respondents to consider the claim of the petitioner in the lines and on par with his juniors. The learned Counsel further submitted that the age of the petitioner at the time of filing of this writ petition was 48 years and presently, the petitioner must be 65 years and he must have retired from service and therefore, the writ petition has become infructuous.

Recording the above submission of the learned Counsel for the petitioner, the Writ Petition is dismissed as infructuous. No costs. Consequently, miscellaneous petitions, pending if any, shall stand dismissed.
