ORDER
Heard learned counsel on either side.
This writ petition is filed seeking to declare the proceedings dated 23.2.2015 issued by the 2nd respondent in terminating the petitioner from service, as arbitrary and illegal.
The petitioner was appointed as Driver in respondentCorporation on 11.07.2013. While so, on 16.10.2014, the petitioner was subjected to breath analyzer test, which indicated that he was under the influence of alcohol with 31 mg/100m percentage. Pursuant to the same, the 2nd respondent conducted preliminary enquiry on 29.10.2014 and passed order dated 30.10.2014 placing the petitioner under suspension.
At the hearing, it is brought to the notice of this Court that the appeal dated 25.04.2015 preferred by the petitioner is pending before the second respondent.
Under these circumstances, without going into the merits of the case, the Writ Petition is disposed of directing the second respondent to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
