Heard the counsel for petitioners, and the learned Government Pleader for Revenue, for respondents.

The grievance of petitioners is that petitioners are in possession of land in Survey No.146/5, situate at Kocherlakota Revenue Village in Dondakonda Mandal, Prakasam District, and have raised certain crops for a long time; and that the respondents are attempting to dispossess them without following the due process of law under the Andhra Pradesh Land Encroachment Act, 1905.

The learned Government Pleader for Revenue, appearing for respondents, states that the respondents will take action under the Andhra Pradesh Land Encroachment Act, 1905 and take possession of the land from petitioners.

In view of the said submission, the Writ Petition is disposed of directing respondent nos.1 to 4 not to evict petitioners from the subject land without following the procedure prescribed under the Andhra Pradesh Land Encroachment Act, 1905. No order as to costs. 5.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
