When the matter is taken up for hearing, there is no representation for the appellant.

It is represented that Mr. K.L.N.Rao, learned counsel for the appellant is no more and the record is not available with the Court and only part of the record is available with the learned Government Pleader. The matter is pertaining to the year 1995 and as there is no representation for the appellant, this Court is of the considered view that the appellant is not interested to pursue the litigation.

Hence, the Appeal is dismissed for nonprosecution. No costs.
