THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19823 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondents 4 and 5 in sending constables to the house of the petitioners at Madurai, Tamil Nadu, harassing the petitioners to come to their Police Station and threatening the petitioners to arrest in connection with crime No.143 of 2016, though all the petitioners were not arrayed as accused in said crime, as illegal and arbitrary.
Heard the learned counsel for the petitioners and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. At the time when the matter is taken up for hearing, the learned AGP submits that insofar as petitioners 4 and 5 are concerned, a notice under Section 41-A Cr.P.C. has been issued in connection with crime No.143 of 2016 registered for the offences punishable under Sections 420 and 406 of Indian Penal Code. Insofar as other petitioners are concerned, he submits that if the respondents-Police intend to take any action against those petitioners, they will follow due process of law. Having regard to the above, the Writ Petition is disposed of directing the respondents-Police to follow the procedure established under law, if they intend to take any action against the petitioner Nos.1 to 3 and 6.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
