HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5784 OF 2015 ORDER:
This Criminal Petition is filed by the petitioners/A1 and A2 under Section 482 Cr.P.C to quash the proceedings in F.I.R.No.625 of 2015 of Banjara Hills Police Station, Hyderabad, for the offences punishable under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Sections 420, 406 and 506 I.P.C.
Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State, before notice to respondent No.2/de facto complainant and before admission.
Perused the material on record. The facts fall short for this Court to admit the application under Section 482 Cr.P.C. but for his entitlement to the concession of regular bail.
Having regard to the same, this criminal petition is disposed of giving liberty to the petitioners to surrender before the learned Special Judge concerned and move for regular bail with notice to Special Public Prosecutor concerned and in such an event the learned Magistrate shall hear and grant bail with necessary conditions. It is needless to say, the learned Magistrate could not insist
the presence of the petitioners pending investigation before the Court. Any other remedy is left open to the petitioners, in the event of police filing final report. Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
