The grievance of the petitioner in the present writ petition is that out of total extent of 99-50 sq.yards though an extent of 36.66 sq.yards of land was acquired by the Government for the purpose of road widening and compensation was also paid to the petitioner, the respondents are demanding to pay property tax for the entire extent of 99-50 sq.yards. 2.

According to the petitioner, he made number of requests to the respondent authorities for re-assessment of the property to the extent of 6284 sq.yards only, which has been in his possession, but there is no response and on the other hand, the respondent authorities are threatening to seize the property.

The learned Standing Counsel appearing for the Respondent Corporation, on instructions, submits that the grievance of the petitioner will be considered and revised demand notice would be issued to the petitioner after assessing the property afresh.

Recording the said submission, the writ petition is disposed of, directing the respondents to issue revised demand notice to the petitioner, after assessing the property afresh by duly taking into consideration the extent of land held by the petitioner after deducting the acquired portion of land from the purview of tax. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. _____________________ CHALLA KODANDA RAM, J Date: 11.3.2019 DA
