ORDER

This contempt case is filed complaining wilful disobedience on the part of the respondents in implementing the order dated 12.07.2013 passed by this Court in W.P.No.11967 of 2001.

When the matter is taken up for hearing, learned Government Pleader appearing for the respondents submits that the respondents have complied with the order passed by this Court on 12.07.2013 and proceedings dated 7.9.2018 have been issued to that effect.

Learned counsel appearing for the petitioner submits that though this Court vide order dated 12.07.2013 allowed W.P.No.11967 of 2001 directing the respondents to issue proceedings within four weeks, the respondents have reinstated the petitioner into service on 21.11.2014 nearly one year three months after passing of the order. He further submits that since the respondents have not extended the regular pay attached to the post of regular Mazdoor, it is not true compliance.

Having considered the submissions made by the learned counsel on either side, this Court is of the considered view

that the respondents have considered the case of the petitioner and issued proceedings on 07.09.2018. If at all the petitioner is aggrieved, it is open to him to challenge the said proceedings, in accordance with law.

Accordingly, the Contempt Case is closed.

Miscellaneous petitions, if any, pending shall stand closed.
