HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.5090 of 2017 O R D E R:

This writ petition is filed challenging the action of the 1st respondent.

2. A perusal of the order dated 01.12.2016 shows that the Assistant Commissioner of Police submitted a report to the Executive Magistrate with regard to the disputes relating to the property admeasuring Ac.60.00 cents of land in Sy.No.9/ 1/ F, 9/ 1/ H and 9/ 1 of Saroor Nagar village and Mandal, Ranga Reddy District. He requested the Executive Magistrate to invoke the provisions of Section 145 Cr.P.C. in view of the grave situation in the interest of maintenance of law and order at the disputed site.

3. Learned counsel for the petitioner submits that the police are interfering with the civil disputes. In view of the report of the Assistant Commissioner of Police, it cannot be said that the police are interfering with the civil disputes. It is open to the Executive Magistrate to take up the issue and deal with the matter in accordance with law.

4. With the above observation, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
