HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32018 OF 2017 O R D E R :

This petition is filed for a writ of mandamus declaring the action of the respondents in not selecting the petitioner for the post of (SCT) Reserve Sub Inspector of Police (TSSP) (Men) in Police Department (Post code-14), as illegal and arbitrary. Learned counsel for the petitioner submits that though petitioner is meritorious, his case is not considered for appointment, as such he made representation dated 04.09.2017 which is pending before the 4th respondent.

On the other hand learned Government Pleader for services submits that equal marks are obtained by two persons, and that the person who born earlier will be considered. Since the representation of the petitioner is stated to be pending before the 4th respondent, it is for the 4th respondent to take appropriate action.

In view of the same, without expressing any opinion on merits the writ petition is disposed of directing the 4th respondent to dispose of the representation of the petitioner dated 04.09.2017, in accordance with Rules and Regulations. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
