THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.15054 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Cr.P.C to quash the proceedings in C.C.No.172 of 2016 on the file of the Judicial Magistrate of First Class, Udayagiri, SPSR Nellore. During hearing, Smt. Marella Radha requested this Court to order for dispensing with the presence of the petitioners while not pressing the other grounds.

In view of the submission made by the learned counsel for the petitioners, the petitioners are permitted to file an application under Rule 37 of Civil Rules of Practice before the Judicial Magistrate of First Class, Udayagiri, SPSR Nellore, where the case is pending and after giving notice to the public prosecutor, the Court shall decide the application in accordance with law to dispense with the presence of the petitioners before the Court.

With the above direction, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
