THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.23176 OF 2016 ORDER:

This writ petition is filed challenging the action of the respondent in refusing to receive the application for correction of place of birth as per Gram Panchayat Secretary, Kasava Pentapadu village and Mandal, West Godavari District. 2.

A counter-affidavit is filed by the 2nd respondent stating that at the time of issuance of a passport on 15-01-2003, the petitioner mentioned the place of birth as Mudunuru, West Godavari District. Subsequently, he obtained another certificate on 26-12-2009 stating that the place of birth is Kasava Pentapadu village. After obtaining the said certificate, he has not approached the 2nd respondent.

In view of averments made in the counter-affidavit, it is open to the petitioner to approach the 2nd respondent for issuance of a fresh passport based on the certificate obtained by him after complying with the necessary formalities. 4.

Accordingly, the writ petition is disposed of No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
