THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO W.A.No.819 of 2016 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) An affidavit dated 31.07.2016 was filed by the appellant unconditionally undertaking to vacate the subject premises, in which he is storing LPG Cylinders, on or before 01.10.2016 voluntarily and without the requirement of any legal process. It is only in the light of this undertaking that this Court granted interim stay for a limited period. As the time sought to voluntarily vacate the premises is just around a month from today, Sri C.Madhu, learned Standing Counsel for GHMC, would fairly state that, if the undertaking is recorded and the appellant acts in accordance therewith, the respondents would not take any coercive steps to demolish the subject structures till 01.10.2016.

Recording the undertaking of the appellant, in his affidavit dated 31.07.2016, that he would unconditionally and voluntarily vacate the subject premises on or before 01.10.2016, the Writ Appeal is disposed of directing the respondents not to take any coercive steps, for demolition of the subject structures, till 01.10.2016. It is open to the respondents, if need be, to take action, in accordance with the notice issued by them under Section 636 of the GHMC Act, 1955, on or after 01.10.2016. The Writ Appeal stands disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
