Heard the learned counsel for the petitioners; the learned Government Pleader for Land Acquisition for the State of Andhra Pradesh appearing for the respondents 1 to 3 and the learned Standing Counsel for National Highways appearing for respondent No.4. With their consent, the Writ Petition is disposed of at the admission stage itself.

The present Writ Petition came to be filed seeking issuance of writ of mandamus, declaring the action of the respondents in trying to dispossess the petitioners from their respective houses in RS No.39/1, Chalivendrapalem Village, Kankipadu Mandal, Krishna District, without following due process of law, as illegal and arbitrary, consequently, direct the respondents not to dispossess the petitioners from their respective houses without following due process of law.

At the time when the matter is taken up for hearing, learned counsel for the petitioners mainly submits that the respondent authorities are trying to dispossess the petitioners from their respective houses, who are in possession of the same, under the guise of survey and markings.

Learned Standing Counsel for National Highways, basing on the written submissions, would submit that the allegations made in

CPK,J WP_22346_2017 the affidavit are all false and that any action to be taken by the authorities will be in accordance with law.

Having regard to the submissions made, the Writ Petition is disposed of directing the respondents not to dispossess the petitioners from their respective houses under the guise of survey and markings of the land, except in accordance with the procedure established by law. However, this order will not preclude the respondents from conducting survey and markings of the land in accordance with law.
