HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Writ Petition No.4200 of 2018 ORDER:

Heard the learned counsel for the petitioner-School and also the leaned Govt.Pleader for Endowments representing the R.1 to R.3 and Sri A.Jagan Mohan Reddy learned standing counsel for R.4-temple from oral instructions offers to appear and perusing the prayer in the writ petition with supporting affidavit averments and the material on record.

The prayer in the Writ Petition reads as follows:- " To issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in issuing the Notice dt.05.01.2018 and insisting the petitioner to vacate the premises i.e. First Floor of Sri Ramchandraji Hanuman Devasthanam, H.No.11-1-890, Mallepally, Hyderabad within one month from the date of receipt of the notice, as illegal, arbitrary and unconstitutional and consequently set aside Notice dated 05.01.2018 issued by the Respondent No.4 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice."

The very writ petition is questioning the action of the respondents in directing the petitioner to vacate the premises to construct Gopuram on the temple where at first floor the so called school is run by the petitioner which is since inauspicious, the petitioner cannot maintain a school in the property but for to vacate by securing alternative accommodation for said pious purpose of the premises of the Endowment.

Having regard to the above, the Writ Petition itself is disposed of by granting time to complete the present academic year before the end of April and to vacate at any cost by 15th of May,2018. Failing which the authorities can proceed pursuant to the show cause notice dt.05.01.2018 and evict him(School).

Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
