HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO C.R.P.No.3519 OF 2016 ORDER :
Impugning the order dated 30.04.2016 of the Senior Civil Judge, Miryalaguda, passed in I.A.No.154 of 2016 in the matrimonial O.P.No.72 of 2015 for the interim maintenance claimed by the wife for her and her minor child, this revision petition is filed.
Petitioner, a law graduate is working as a teacher in some school was drawing gross salary of Rs.34,000/- per month, in March, 2016 and net salary of Rs.31,000/-. Salary certificate is marked as Ex.R.1. Ex.R.2-rent certificate, his own other document, shows that he was paying rent of Rs.6,000/- per month for the premises he occupied for his stay. The trial Court since awarded to the wife and minor child each Rs.5,000/- per month, he maintained the revision impugning the quantum as excessive to reduce. Heard. Perused the material available on record. When on his own saying for his residence Rs.6,000/- per month rent is required, and the wife and child to survive with same status by stay in a similar rented premises, Rs.10,000/- per month interim maintenance awarded is thus in no way requires interference by this Court, but for to grant time to pay the arrears paid in five equal monthly installments after receipt of the order.
DrSSRBJ Accordingly, the civil revision petition is disposed of while confirming the quantum however permitting the revision petitioner to pay the arrears of maintenance in five equal monthly installments after receipt of the order. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, in the revision shall stand closed.
