HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.4032 of 2018 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue, Prohibition & Excise and Home for respondents from oral instructions and perused the prayer in the writ petition with supporting affidavit and orders in similar matters passed by Two Single Benches respectively enclosed to the writ petition. 2.

The prayer in the writ petition reads as follows: "..........to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent No.2 in harassing by interfering w3ith the business of the petitioner in white jaggery, colour jaggery and alam under valid licence and bills and not allowing the petitioner to carry on business in white jaggery, colour jaggery and alam and visiting the shop and the godown, as illegal and arbitrary and without any authority of Law and consequently direct the respondent No.2 and 3 not to interfere or in any manner seize the stocks and the vehicles while transporting the white jaggery, colour and alam, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

It is the submission of the respective learned Government Pleader for the respondents that the alleged harassment by the 2nd respondent-Station House Officer, Kolhapur Prohibition and Excise Police Station, averred so and so any apprehension of interference by the 3rd respondent is with no basis, leave about they are entitled pursuant to the statutory provisions of any excise cases including any

illicit transport of any jaggery for illicit liquor manufacturing if at all they come across.

By recording the said fact, the writ petition is disposed of directing respondent Nos.2 and 3 not to interfere unnecessarily with the business of the petitioner except through due process of law. Miscellaneous petitions pending, if any, shall stand closed. No costs.
