THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.26577 of 2013 ORDER:
Heard learned counsel for the petitioners and learned Standing Counsel for respondents.
The petitioners made an application dated 01.10.2011 to the National Council for Teacher Education (for short 'the NCTE') for grant of recognition to D.EI.Ed colleges. Since the said application was rejected by the 2nd respondent vide order dated 06.03.2012, the petitioner filed statutory appeal on 14.01.2013 before the 1st respondent. The 1st respondent dismissed the same on 01.03.2013. Calling in question the validity and legal sustainability of the said orders passed by the respondents, the present writ petition is filed.
Sri K.Ramakanth Reddy, learned Standing Counsel for respondents, on instructions, submits that the application of the petitioner was duly considered, and by virtue of an order dated 06.03.2012, the same was rejected by the 2nd respondent and the appeal filed by the petitioners also ended in dismissal vide order dated 01.03.2013.
Evidently, the application of the petitioners was rejected long back and now it is not possible for reviving the said application, which was considered and rejected by the NCTE, in view of advent of NCTE regulations, 2014. Since new regulations came into existence, the petitioners cannot seek consideration of the application submitted under the old regulations.
In view of the same, this Writ Petition is disposed of, permitting the petitioners to make appropriate application to the respondents in
terms of new NCTE Regulations, 2014, and if any such application is made by the petitioners, the same shall be considered and appropriate orders be passed by the respondents in accordance with law. No costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
