THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.12185 of 2012 ORDER:

While the petitioner claims to be the daughter of the deceased, in whose favour electricity service connection was hitherto granted, the 5th respondent claims to be the brother of the deceased, and to be entitled for transfer of the electricity service connection granted earlier in her favour. While the 5th respondent admits that the petitioner is the daughter of the deceased, the petitioner, however, contends that the 5th respondent is not the brother of her mother.

The 5th respondent had earlier filed W.P.No.31185 of 2011, without arraying the petitioner herein as a respondent, seeking a mandamus to declare the action of the Assistant Engineer in disconnecting power supply. W.P.No.31185 of 2011 was allowed, by order dated 30.11.2011, directing the respondents to restore power supply to the two agricultural service connections. The 5th respondent herein was directed to approach the 2nd respondent with an appropriate application for transferring the service connection in his name within a period of one month; and, if such an application was received, the 2nd respondent was directed to consider and take appropriate action thereon. The Learned Judge made it clear that, if the 5th respondent herein did not make any application, the 2nd respondent was free to issue notice to the 5th respondent herein, and take appropriate action in accordance with the general terms and conditions of power supply.

Now the petitioner, the daughter of the deceased, has invoked the jurisdiction of this Court contending that the electricity connection should be transferred in her name, and that she has submitted a representation dated 07.01.2012 to the 2nd respondent making such a request. The fact, however, remains that neither the petitioner's nor the 5th respondent's representations have been considered till date. As there

is a dispute, as to who is entitled to be provided electricity connection No.42, and as both the petitioner and the 5th respondent have submitted representations in this regard, suffice it to direct the 2nd respondent to consider both the representations, cause an enquiry into the matter, and pass appropriate orders, in accordance with law, with utmost expedition and, in any event, not later than three months from the date of receipt of a copy of this order.

The Writ Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
