HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.12887 of 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the Petitioners-A3, A4, A5 & A6 to quash the proceedings initiated against them in Crime No.151 of 2015 on the file of Morthad Police Station, Nizamabad District, registered for the offence punishable under Section 494 I.P.C.

On a complaint given by the 2nd respondent herein, a case in Crime No.151 of 2015 was registered against the petitioners and others by the Sub Inspector of Police, Morthad Police Station for the aforesaid offence. It is alleged in the complaint that the marriage of the 2nd respondent-complainant was performed with Accused No.1 on 05.05.2002 and at the time of marriage, the parents of the 2nd respondent gave Rs.10,00,000/- as dowry and gold ornaments as presentations. Thereafter, they were blessed with a male child on 02.10.2003 and since then Accused No.1 and his parents started harassing the 2nd respondent for additional dowry. It is further alleged that on 06.09.2015 the husband of the 2nd respondent i.e., A-1 got married one Pravallika, daughter of one Gaddam Linga Reddy, with the support of the petitioners herein.

Heard the learned Counsel appearing for the petitioners and the learned Public Prosecutor, representing the State. The allegations in the complaint prima facie reveal the commission of alleged offence by the petitioners-accused. It is a matter, which requires investigation by the police. Therefore, I see no grounds to interfere at this stage with the investigation of the case. Having regard to the aforesaid facts and circumstances of the case, the Criminal Petition is disposed of with a direction to the

Investigating Officer to proceed with the investigation expeditiously, however, the petitioners-A3 to A6 shall not be arrested without following the procedure as contemplated under Section 41A Cr.P.C.
