THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.4045 of 2018 Order:

This Writ Petition is filed for the following relief. "To issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 3 and 4 in collusion with the 5th respondent have issued the proceedings No.SB/NG/NG/CY/2016/207977 and SB/NG/NG/CY/2016/207980, dated 06.08.2017 under Section 5A of ROR Act, and trying to mutate the name of the respondent No.5 in the revenue recorda dn also trying to issue patta passbook and title deed in favour of the respondent No.5 in respect of agricultural lands to an extent of Ac.0-04 gts., in Survey No.811, extent of Ac.0-03 gts., in Sy.No.813, extent of Ac.0-03 gts., in Sy.No.814, extent of Ac.0-03 gts., in Sy.No.819, extent of Ac.0-23 gts., in Sy.No.821 and extent of Ac.0-24 gts., in Sy.No.822, total extent of land Ac.1-25 gts.

, situated at Veliminedu village, Chityal mandal, Nalgonda District, is illegal, arbitrary, mala fide and violation of Articles 14, 21 and 300 A of the Constitution of India and without following the due process of law and set aside the same and consequently direct the respondents not to mutate the name of the 5th respondent in the revenue records in respect of the above lands." Since this Court noticed that there is a provision for appeal against the impugned order passed under Section 5A of the ROR Act on 06.08.2017 and, in view of the availability of alternative remedy, this Court is not inclined to entertain the present Writ Petition.

The Writ Petition is, accordingly, dismissed. However, liberty is given to the petitioner to avail the alternative remedy of appeal available to him under law. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
