The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus to declare the action of the respondents No 4 in not issuing Pattadar Pass Book and Title Deeds in the petitioners lands in Sy Nos 180AA Ac 4 00 Gts Sy No 181 1 38 Gts Sy No 182 Ac 2 02 Gts Sy No 183 Ac 4 27 Gts and Sy No 225 Ac 2 39 Gts of Peddagollaggudem Village Dammapeta Mandal Bhadradi Kothagudem District after issuance of 1 B Certificate under ROR as illegal and void violation of the principal justices and please direct the respondent No 4 to issue Patta Pass Books and Title Deeds along with other benefits issued by the State Government and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."

Perusal of the record reflects that the name of the petitioner was entered in the Form I-B revenue record in relation to the subject lands. Therefore, it is clear that the necessary mutation has already been carried out in his favour in the revenue records. That being so, it is not open to the revenue authorities to fail to issue him the necessary new pattadar passbook, so that he can avail the benefit of the Government's Rythu Bandhu scheme. However, the petitioner seems to have approached the District Collector, Bhadradri Kothagudem District, directly, without submitting any written representation to the Tahsildar, Dammapet Mandal, Bhadradri Kothagudem District. Without approaching the appropriate authority, it is not open to the petitioner to complain of inaction.

The Writ Petition is accordingly disposed of permitting the petitioner to make a written representation to the Tahsildar, Dammapet Mandal, Bhadradri Kothagudem District, for issuance of the new pattadar passbook. In the event the petitioner makes such an application, the Tahsildar, Dammapet Mandal, Bhadradri Kothagudem District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of such application.

Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
