THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.5382 of 2011 ORDER:

This civil revision petition under Section 115 of the Code of Civil Procedure, 1908, is filed assailing the order dated 29.09.2011 of the learned Senior Civil Judge, Allagadda, passed in EP.No.30 of 2011 in OS.no.18 of 2006 filed by the plaintiff-decree holder under Order XXI Rule 43 of the Code of Civil Procedure, 1908.

By the said order, the executing Court ordered attachment of an amount of Rs.2,685/ - per month from the salary of the 1st JDr for a period of 21 instalments and Rs.1,856/ - towards 22nd instalment to be deducted from the pay bill of October, 2011 payable in the month of November, 2011. This revision petition is pending for admission and no interim order is granted.

As could be seen from the order impugned, the said period of 22 months expired long back and it appears the order worked out for itself. Therefore, in the considered view of this Court, no useful purpose would be served by keeping this revision petition pending.

Accordingly, the Civil Revision Petition is dismissed as infructuous. Miscellaneous petitions, if any, pending in this revision shall stand closed. There shall be no order as to costs. _____________________ M. SEETHARAMA MURTI, J 05.01.2017 Vjl
