THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16394 of 2013 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the inaction of the respondents in proceeding with the investigation in FIR No.51 of 2013, pending before the 3rd respondent, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioner is that the marriage of the petitioner was performed with the 5th respondent on 17.05.2005 as per Hindu rights and customs and at the time of marriage, the father of the petitioner gave Rs.10,00,000/-, 50 tulas of gold, 3 kgs of silver articles and valuable cloths and other articles towards dowry on demand of respondents 5 to 11 and that since day one of the marriage, respondents 5 to 9 used to harass the petitioner on one pretext or the other asking her to bring additional dowry of Rs.10,00,000/- as they are in debts. Aggrieved by the same, the petitioner has lodged a complaint before the 3rd respondent and the 3rd respondent registered the same as FIR No.51 of 2013, dated 11.06.2013, against respondents 5 to 11 for the offences punishable under Section 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act. Though the 3rd respondent has registered the case, but the 3rd respondent is not completing the investigation in FIR No.51 of 2013.

Considering the grievance of the petitioner and since the matter is pertaining to the year 2013, the 3rd respondent is directed to complete the investigation in FIR No.51 of 2013 as expeditiously as possible and file a final report, if any, either way in accordance with law. If

investigation in FIR No.51 of 2013 is already completed and charge sheet is filed, then this order need not be given effect to. Accordingly, the Writ Petition is disposed of. No costs.
