HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7137 OF 2015 ORDER:
Challenging the inaction of the respondents in considering the several representations of the petitioner, the present writ petition is filed.
The grievance of the petitioner is a limited to the extent that the 4th respondent is not effecting the changes in the revenue records inspite of the judgment and decree dated 05.02.1996, passed by the I Additional District Munsif Court, Kovvur in O.S.No.641 of 1989 and on appeal the same was confirmed by a judgment and decree dated 02.06.2008, by the Additional Senior Civil Judge, Kovvur, in A.S.No.58 of 1996. The petitioner also furnished necessary copies of judgments and decrees of the trial courts and sought mutation of his name in the revenue records with respect to the land admeasuring Ac.10.00 cents in RS.No.394, Parimpuri Village, Koyyalagudem Mandal, West Godavari District. Heard Sri K. Sarvabhouma Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
On perusal of the material placed before this Court, the 4th respondent-Tahsildar had, infact, taken up enquiry and, in the process, required certain clarifications from the petitioner especially with respect to the finality attached to the judgment and decree dated 02.06.2008 passed by the Additional Senior Civil Judge, Kovvur in
A.S.No.58 of 1996.
This is evident from the communication endorsement made by the 4th respondent on 16.08.2014. The petitioner submits that the notarized affidavit as required by the 4th respondent-Tahsildar was furnished by the petitioner on 11.09.2014. Keeping up the matter pending without completing the process of mutation itself would amount to nonperforming of the statutory duty conferred on the 4th respondent. In that view of the matter, there shall a direction to the 4th respondent-Tahsildar to complete the process of enquiry and take necessary action on the application of the petitioner dated 23.02.2011 seeking mutation of her name in the revenue records by deleting her sister's name within a period of three months from today.
With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
