CVNR, J & TR, J FCA.No.24 of 2009 Dated:30.01.2017 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Family Court Appeal is listed "for being referred to Arbitration and Conciliation Centre".

Mr. C.Kumar, learned counsel representing Mr. P.Shiv Kumar, learned counsel for the respondent-wife, submitted that the present Family Court Appeal arises out of order, dated 16.9.2008, in O.P.No.224 of 2007 on the file of the Judge, Family Court, Secunderabad, filed for divorce; that after the filing of this appeal, O.P.No.253 of 2014 was filed by both parties for dissolution of marriage by mutual consent under Section-13-B of the Hindu Marriage Act, 1955; that by order, dated 15.12.2014, the Judge, Family Court, Secunderabad has decreed the said O.P; and that therefore, the cause in the present appeal does not survive for adjudication.

Learned counsel for the appellant is not present and therefore, the submission of the learned counsel for the respondent remained uncontroverted.

In view of the afore-mentioned subsequent event brought out by the learned counsel for the respondent, the Family Court Appeal is disposed of as infructuous.
