THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 14355 OF 2017 O R D E R :

This Writ Petition is filed complaining that the 2nd respondent Corporation is proposing to lay the drainage canal through the petitioner's land admeasuring Ac.1.50 cents in Survey No. 158/5 and Ac.1.61 cents in Survey No. 159/4 situated at Gunadala Village, Vijayawada Urban Mandal, Krishna District, without following the procedure contemplated under the relevant statutes.

Heard learned counsel for the petitioner.

Learned Standing Counsel for the 2nd respondent Corporation denies the allegation of the petitioner. However, it is directed that the 2nd respondent Corporation shall not interfere with the possession of the petitioner over the subject land. It is made clear that if the land of the petitioner is required for any public purpose, the same shall be interfered with only by following the due process including payment of compensation under the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The Writ Petition is accordingly, disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
