THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.25378 of 2017 ORDER:

In this Writ Petition, petitioners challenge notices, dated 01.05.2017 and 15.06.2017 issued by the second respondent - Ibrahimpatnam Gram Panchayat, represented by its Secretary, Ibrahimpatnam, Krishna District, alleging that they had made certain constructions by illegally occupying the land of the Gram Panchayat.

The second respondent filed a counter-affidavit stating that the petitioners have encroached into the road margin and made construction thereon without obtaining any permission from the Gram Panchayat; that the answering respondent never threatened the petitioners and that they issued the impugned notices by following due process of law.

Inasmuch as the petitioners challenge is only with respect to the notices issued by the second respondent, this Court disposes of the Writ Petition giving liberty to the petitioners to submit explanation to the notices impugned, within a period of ten days from the date of receipt of a copy of this order, and on receipt of such explanation, the second respondent shall consider

CKR, J W.P.No.25378 of 2017 and pass necessary orders within a period of two weeks thereafter. Till such time, no demolition shall be undertaken. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
