ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.12 of before the
Ellanthakunta Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 109(1), 351(2), 324(2) read with 3(5) of BNS.

The brief facts of the case are that the de facto complainant lodged a report before the police on 14.01.2026 stating that the de facto complainant, working at a tea stall in Narsakkapet village, had married Yamuna in the year 2010 and they were blessed with one male child. Over time, his wife developed an illicit relationship with the petitioner, which she voluntarily confessed and expressed her unwillingness to live with the de facto complainant. On 11.01.2026 at about 5:30 PM, while the de facto complainant was working at his tea stall, the petitioner and accused No.2-Bolla Bal Reddy came to the stall, forcibly dragged him outside, and attempted to murder him by assaulting with a centering stick, causing injury to the back of his head. Accused No.2 further snatched and broke the mobile phone of the de facto complainant, and both accused threatened to kill him. The incident was witnessed by Kota Raji Reddy and Thipparaveni Aravind.

Heard Sri A. Krupadhar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged allegations and has been falsely implicated in this case due to previous disputes. He further submitted that no such injuries were inflicted on the de facto complainant and that the petitioner is ready to cooperate with the investigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. He further submitted the injuries are simple in nature and that the investigation is not yet completed. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioner was arrayed as accused No.1. The main allegation against the petitioner is that, owing to the alleged extra-marital relationship between the petitioner and the wife of the de facto complainant, disputes arose between the parties and the petitioner attacked the de facto complainant. However, the injuries sustained are simple in nature. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Ellanthakunta Police Station, Rajanna Sircilla District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
