HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to be the owner of property bearing House No.8-14-7/4 in Sy.No.38/1, opposite Mir Alam Tank, Bumrukuddowla village, National Highway-9, Rajendra Nagar Mandal, Ranga Reddy District. The said property is occupied by the tenant, arrayed as 4th respondent, to an extent of 440 square feet for doing Industrial Chemical Business. Petitioner alleges that he is using electricity supply service connection no.V3011119 under Category-LT II(B), non-domestic. Petitioner alleges that 4th respondent is indulging in theft of electricity, whereas respondent-company is proceeding against the petitioner and in this Writ Petition, petitioner prays to direct the respondent-company to take action against 4th respondent, who is occupying the subject premises. 2.

Learned counsel for petitioner does not dispute the fact that power supply connection stands on the name of petitioner. When power supply connection stand on his name, it is the responsible of the person, in whose name the power supply connection is granted, to ensure that occupier of the premises does not use and indulge in theft of electricity. The respondent-company cannot be asked to proceed against the occupier of the premises when power supply connection stands in the name of petitioner. Thus, relief as sought for cannot be granted. If petitioner has any other grievance vis-à-vis his tenant, he has to work out his remedy as available in law. Writ Petition is accordingly dismissed. Pending miscellaneous petitions shall stand dismissed.
