THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.1280 of 2022 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.4, for grant of bail in Crime No.165 of 2021 of Enkur Police Station, Khammam District, registered for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Heard the learned counsel for petitioner/A.4, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

The case of prosecution is that on 27.10.2021, while A.1 to A.3 were transporting ganja, they were apprehended and pursuant to their confession, 70 kgs of dry ganja was recovered under a cover of panchanama. The allegation against the petitioner/A.4 is that A.1 to A.3 engaged the petitioner/A4 to sell ganja to others. It is brought to the notice of this Court that A3 in the subject crime was granted bail by this Court vide order dated 31.12.2021 passed in Crl.P.No.8962 of 2021.

Under these circumstances, the petitioner/A.4 is ordered to be released on bail, subject to the following terms and conditions:

(i) The petitioner/A.4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties, in a like sum each to the satisfaction of the learned Principal Judicial Magistrate of First Class, Kothagudem, Khammam District.

(ii) After release on bail, the petitioner/A.4 shall appear before the Station House Officer, Enkoor Police Station, Hyderabad, on every Sunday between 06:00 AM and 06:00 PM for a period of three months from today. 5.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
