THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.11650 OF 2016 ORDER:

This Criminal Petition under Section 482 Cr.P.C. is filed to call for the records relating to C.C.No.319 of 2014 pending on the file of IV Additional Chief Metropolitan Magistrate, Visakhapanam and quash the same.

It is fairly conceded by learned counsel for the petitioner/accused as well as learned counsel for respondent No.2 that similar issue came up before this Court in Killi Kruparani V. The State of A.P. (Crl.P.No.5938 of 2009) and this Court held that filing of complaint is abuse of process of law. Earlier in a similar issue, this Court quashed the proceedings in V.Narayana Reddy Vs. State of A.P (Crl.P.No.3426 of 1998), dated 05.06.2002. 3.

Following the said two orders, this Criminal Petition is also allowed setting aside the proceedings in C.C.No.319 of 2014 on the file of IV Additional Chief Metropolitan Magistrate, Visakhapatnam, against the petitioner/accused herein.
