Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as Fair Price Shop Dealer of Shop No.55 of Peda Agraharam Village, Piduguralla Mandal, Guntur District. He applied for leave on health grounds from 19.01.2017 to 18.07.2017 and the same was received by the 4th respondent on 19.01.20071. The petitioner underwent treatment for six months.
Meanwhile, arrangements were made for distribution of essential commodities by one Sri Hanuman MPG Dwakra Group, Piduguralla, by the 4th respondent. The petitioner states that after expiry of leave, he approached the 4th respondent and when the 4th respondent did not pass any orders, the present writ petition is filed.
After adjourning the matter, the learned Government Pleader obtained written instructions. It is sated that the petitioner has not approached the concerned authority after expiry of his leave and in view of the same, no action was taken in respect of the petitioner. The petitioner also did not file any application in support of his case in the present writ petition.
In the circumstances this writ petition is disposed of with liberty to the petitioner to approach the concerned authority with a written representation seeking restoration of supply of essential commodities since the authorization of the petitioner is valid up to 31.03.2018. As and when such representation is received, the 3rd respondent shall
consider the same and pass appropriate orders within a period of two (2) weeks.
The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. _______________________ A.RAMALINGESWARA RAO, J October 23, 2017 KTL
