There is no representation on behalf of the petitioners. Heard the learned standing counsel appearing for the respondent No.2. The prayer sought for in the writ petition is as under: " to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the proceedings in Rc. No. 48/ B/ SSA/ SKL/ 2014 dt 22/ 12/ 2014 in permitting to construction of additional rooms at Yarravaram village when the school is in V. N. Puram Village which is far away from the School premises is arbitrary, illegal in nature and consequently direct the respondents to issue fresh proceedings for construction of two new additional rooms in Sy. Nos. 29/ 8, 29/ 12, 29/ 14 in V. N. Puram Village of Ranastalam Mandalam by the 5th respondent".

The 2nd respondent filed a counter affidavit stating that the Zilla Parishad High School at V.N.Puram, Ranasthalam Mandal of Srikakulam is having only two class rooms and is located nearby burial ground. There is fear among the students in attending the school. Therefore, the District Collector instructed 3rd respondent to construct two additional class rooms sanctioned during the year 2014-15 at the site donated by one Kalisetti Sanyasinaidu and others of the same village in an extent of Ac.1.00 cents in Sy.No.64/ 19 in Yerravaram village, which is adjacent to V.N.Puram village. On the instructions of the District Collector, the 3rd respondent appointed the Deputy Educational Officer, Srikakulam as an enquiry officer to conduct enquiry on the request of the villagers. On enquiry, the said officer reported that the present school is running only with two

class rooms and suffering with inadequate accommodation. It is also said to be reported that the present school is having inadequate accommodation and during the performance of funerals to the dead bodies, the students of the school are experiencing bad smell and fear. As per the orders issued by the 2nd respondent vide proceedings R.C.No.48/ B/ SSA/ SKL, dated 22.12.2014 to the Deputy Executive Engineer, APSSA, Srikakulam, the construction of rooms is already in progress by spending more than Rs.6.00 lakhs. The learned standing counsel appearing for the 2nd respondent, during the course of hearing, brought to the notice of this Court that the said rooms are already constructed. In view of the above, this Court is of the opinion that no further orders are required in the writ petition and the same is accordingly dismissed. No costs.
