HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 4434 of 2018 ORDER:
The present Writ Petition is filed seeking issuance of a writ of mandamus directing the second respondent to pay a sum of Rs.88,000/ - towards professional fee to the petitioner with interest @ 18% per annum from June, 2016 till the date of relaisation and also direct to pay a sum of Rs.50,000/ - towards compensation.
2. The petitioner being an advocate rendered his services to the respondents since 2004 onwards and after completion of his term he raised a bill of Rs.88,000/ - in terms of his appointment proceedings. Since the amounts were not paid by the respondents the petitioner is before this Court by way of this Writ Petition.
3. Heard both sides.
4. Mr.Rajeswara Rao, learned counsel appearing for the Assistant Solicitor General, vehemently opposed the contention of the petitioner and he stated that the petitioner is not entitled for the relief sought for and the Writ Petition is to be dismissed.
5. Undisputedly, there is an appointment order and the services have been rendered by the petitioner. Apart from that vide letter dated 12.06.2017 some payments made by the respondents to petitioner indicating that the petitioner is entitled for the advocate fee for his services. Hence, it would be just and proper to direct the respondents to look into the matter and clear
the bills of the petitioner payable to him, as expeditiously as possible, preferably, within a period of eight weeks from today.
6. With the above direction, the Writ Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed. No order as to costs. __________________ T. AMARNATH GOUD, J 01.05.2019 gkv
