HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos. 292 and 2662 of 2017 Common Order:

These two Writ Petitions are being disposed of by this common order, as they relate to the non-registration of complaint of the petitioner dated 11.12.2016 against the complainants in Crime No.1022 of 2016, where he was arrayed as an accused.

Crime No.1022 of 2016 was registered against the petitioner, his father and one T. Nageswara Rao by the Station House Officer, Hayathnagar Police Station on the complaint of one Bollu Krishna Murthy. The petitioner approached Vanasthalipuram Police Station and lodged a complaint on 11.12.2016 against the same complainant, but the said complaint was not registered by Vanasthalipuram Police on the ground that a complaint already exists against the petitioner and two others at the instance of one Bollu Krishna Murthy, against whom the present complaint is lodged.

Learned counsel for the petitioner submits that in such circumstances the Station House Officer, Vanasthalipuram Police Station should have registered a Zero-FIR and transferred the FIR to the concerned Police Station, but the same is not done. In the counter affidavit filed by the Inspector of Police, Vanasthalipuram Police Station, it is stated that the police already issued a letter on 10.01.2017 advising the petitioner to approach Hayathnagar Police, but the petitioner has not approached the Hayathnagar Police for dealing with the complaint dated 11.12.2016.

In the circumstances, these Writ Petitions are disposed of giving liberty to the petitioner to approach Hayathnagar Police either to pursue

the original complaint dated 11.12.2016 or lodge a fresh complaint on the same allegations. On receipt of which, Hayathnagar Police shall take appropriate action in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
