HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4878 OF 2019 O R D E R :

This writ petition is filed challenging the final Notice No.APEL/PB/EN/2019/0156, dt.25.02.2019, issued by the 3rd respondent for demolition with regard to petitioner's house property No.B-7, NH-44 in Plot No.1 in Sy.No.463/B, situated at KM 165+980 RHS, Yerravalli Village, Itikyala Mandal, Jogulamba Gadwal District, without issuing preliminary show cause notice.

Learned Counsel appearing for the 3rd respondent submits that the lis in the writ petition is squarely covered by the order dt.01.05.2019 passed by this Court in WP.No.4998 of 2019 and the same is not disputed by the learned counsel for the petitioner.

In view of the same and for the reasons alike, this writ petition is also disposed of directing the petitioners to submit suitable explanation to the show cause notice, within a period of two weeks from today and on such explanation being filed the respondents shall examine the explanation and also cause any enquiry in the presence of the petitioner and pass appropriate orders, as expeditiously as possible, not later than four weeks thereafter. Till the entire exercise is completed the respondents shall not take any coercive steps against the petitioner's property. It is needless to observe that

in the event if there is any encroachment detected, the same may be removed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 02.07.2019 t k.
