HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.28039 of 2016 ORDER:
Vide the present petition, the petitioner seeks a mandamus declaring the action of respondent in refusing to process the passport application No.HYD100727310 dated 22.02.2010 on the ground that the birth certificate does not reflect the names of adoptive parents as illegal and arbitrary.
Learned counsel for the petitioner submits that, till date, the petitioner has not received any communication from the respondent, however, the petitioner procured photo copy of the passport application whereon noted 'Court order'. Thus, no decision was taken and, if any decision taken, not yet communicated to the petitioner.
Learned counsel for the respondent, on advance notice, assured this Court that decision on the petitioner's passport application No.HYD100727310 dated 22.02.2010 shall be taken within two weeks from today, and the same shall be communicated to the petitioner in writing within three days thereafter.
Accordingly, the Writ Petition is disposed of with a direction to respondent to dispose of the petitioner's passport application No.HYD100727310 dated 22.02.2010, in the light of judgment of Kerala High Court in W.P.No.9073 of 2015 (Jayakumar v. Union of India) and circulars dated 13.01.2016 and 19.02.2016 issued by the Government of India, Ministry of External Affairs, within two weeks from today, and the same shall be communicated to the petitioner in writing within three days thereafter. Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
