THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24681 of 2017 O R D E R:

This writ petition is filed for the following substantive relief: "..... to issue an order or direction more particularly one in the nature of writ of mandamus declaring the action of the 3rd respondent in not taking any action on the petitioner's representation dt. 5-7-2017 and not consider the same is illegal arbitrary and violation of principles of natural justice and consequently direct the 3rd respondent to take necessary action on petitioner's representation dt. 5-7-2017 and laid the pending road through the petitioner's land in between Gallavandla Palli to Gundali Malleswara Swamy Temple within the stipulated time by following the proceedings in G1/1158/2013, dt.15-7-2014 of the 2nd respondent." 2.

The claim of the petitioner is that the District Collector vide proceedings dated 15.07.2014, addressed to the Mandal Parishad Development Officer, Mydukur, sanctioned a sum of Rs.5 lakhs for formation and gravelling of the road from Gallavandlapalli to Gundali Malleswara Swamy Temple at Gallavandlapalli of Annaluru Gram Panchayat of Mydukur Mandal. By spending a part of the money, major portion of the road has been laid, leaving a portion of about 122 meters. As a matter of fact, the road has been laid in the petitioner's land, for which he has no objection. Now, the petitioner's grievance is that as the laying of the road is not completed, the public is put to inconvenience.

The learned Standing Counsel appearing for the third respondent, on instructions, submits that by utilizing the money available and if necessary, by seeking some more additional funds, the laying of road would be completed within a period of three months.

Recording the said submission, the third respondent is directed to complete the balance work within a period of three (3) months from today or at any rate before onset of monsoon. 5.

Accordingly, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
