THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4123 of 2018 ORDER:

In this Writ Petition, petitioner challenged the action of the second respondent - Revenue Divisional Officer, Gurajala, Guntur District, in cancelling the authorization of the petitioner in respect of Fair Price Shop No.67 of Panditivaripalem, H/o Guthikonda Village, Piduguralla Mandal, vide order, dated 20.05.2017.

Under the provisions of the Andhra Pradesh State Public Distribution System (Control) Order, 2008, as against the impugned order, there is an effective alternative remedy of appeal available to the petitioner.

Learned counsel for the petitioner submits that before passing the impugned order, no proper enquiry was conducted by the authorities; that the petitioner has filed the present Writ Petition under a mistaken impression and that the appellate authority may be directed to entertain the appeal to be filed by the petitioner and dispose of the same in accordance with law. In those circumstances, the Writ Petition is disposed of permitting the petitioner to file an appeal before the appellate

CKR, J W.P.No.4123 of 2018 authority, by raising all his contentions including the contention that before cancelling his authorization, no proper enquiry was conducted by the authorities, within three (3) weeks from today. There upon, the appellate authority shall dispose of the same on merits, in accordance with law.
