HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 33170 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for FP Shop No. 1808 of Akunur Village, Saidapur Mandal, Karimangar District. It appears that the

Deputy Tahsildar, Civil Supplies, Bheemadevarapally inspected the fair price shop of the petitioner and submitted a report on 19.08.2015, based on which, the third respondent issued a show cause notice on 25.8.2015. On the same day itself, the authorization of the petitioner was suspended pending enquiry. Challenging the same, the present Writ Petition is filed. A perusal of the impugned order shows that there are certain variations in the stock. Further it was alleged that the petitioner was not maintaining records properly. Pursuant to the show cause notice dated 25.08.2015, the petitioner submitted his explanation on 3.9.2015. Having regard to the nature of irregularities made against the petitioner, conduct of enquiry into the same is inevitable.

As the inquiry initiated against the petitioner is pending, this Court is not inclined to enter into the merits or otherwise of the subject matter. Since the dealer has already submitted his explanation denying the allegations levelled against him, the third respondent is directed to complete the enquiry and pass final order within a period of thirty days from the date of receipt of a copy of this order after affording due opportunity to the petitioner to represent his case. Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
