THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38327 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 4th respondent in neither investigating FIR No.93 of 2016 nor arresting the accused, as illegal and arbitrary.

Heard and perused the material available on record. The grievance of the petitioner is that the petitioner preferred the present complaint against the 5th respondent and his wife regarding illegal constructions being carried out by them over H.No.22-3-947/E/1, Purani Haveli, Hyderabad. Even though the complaint is lodged and it is registered as FIR No.93 of 2016 by the 4th respondent, but the 4th respondent is neither initiating any action against the accused nor arresting them.

Considering the grievance of the petitioner, the 4th respondent is directed to complete the investigation in FIR No.93 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 8th November, 2016 KL
