HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.25105 of 2012 ORDER:
This writ petition is filed questioning the action of the respondent authority in issuing notices dated 05-05-2012, 13-06-2012 and 24-07-2012 as illegal and arbitrary and consequently set aside and with a direction that the petitioner is entitled for proportionate reduction of rent in respect of licensed premises or in alternative permit the licensed area for running entertainment center inclusive of Food Court and party zone. The petitioner challenged the notices on various grounds disputing the amounts involved in the impugned notices. Admittedly, the lease period expired by 31-07-2013 and these notices are arising between contractual obligations between the petitioner and the respondents.
When there are disputes regarding the amounts in the notices, the same cannot be decided by exercising power under Article 226 of Constitution of India. It is stated by the counsel for the respondents that another W.P.No.7855 of 2015 filed by the petitioner for similar relief is pending. In view of the expiry of lease period, the petitioner has to work out his remedies. It is stated by the learned counsel for the petitioner that some security deposits are available with the respondents. The petitioner can make application for refund of the same and the respondent shall consider the same in accordance with law and take action for release of the amounts or for adjustment of the dues.
Accordingly, the writ petition is disposed of. As a sequel thereto,
miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
