HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24574 OF 2017 O R D E R :

This writ petition is filed challenging the action of the respondents in constructing a wall about 4 feet height obstructing the passage in front of the wine shop run by him, under the name and style of 'Sri Vijaya Wines', at premises No.726/1, without leaving any place for ingress and egress to the said shop which is situated adjacent to the road leading to Arilova Road, Visakhapatnam. Ventilating the aforesaid grievance, the petitioner also filed representation dated 04.07.2017 before the respondents, but the same is not being disposed of, as such, the business of the petitioner is being affected.

Heard learned counsel for the petitioner.

Sri S.Laxminarayana Reddy, learned Standing Counsel appearing for the respondents vehemently opposed for grant of interim order and also produced a letter dated 27.07.2017 addressed by the Station Officer, Prohibition & Excise Station, Circle-II, Visakhapatnam to the Zonal Commissioner, Zone-1, GVMC, Madhurawada, wherein it is stated that no licence is existing in the name of the petitioner in D.No.726/A, Arilova, Visakhapatnam and the people of the said locality are obstructing for establishment of A4 shop in that locality. Since it is stated that the representation dated 04.07.2017 submitted by the petitioner is pending before the respondents, without expressing any opinion on merits, the writ petition is

disposed of directing the 2nd respondent to dispose of the said representation taking the letter dated 27.07.2017 addressed by the Station Officer to him, into account, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
