HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner alleges that even though no crime is registered against him, 5th respondent is harassing and humiliating by calling him to the Police Station and keeping him in Police Station for hours together. By such conduct, the life and liberty of the petitioner is effected and also effecting his reputation in the society. According to petitioner, based on the false complaint of 6th respondent, 5th respondent is pressurizing and torturing him. 2.

Based on the written instructions furnished by the SubInspector of Police, Kodakandla Police Station of Warangal Commissionerate, dated 11.03.2019, learned Government Pleader would submit that based on the complaint lodged by 6th respondent on 27.02.2019, GD entry was made on the same day, and on prima facie verification, both parties were called to the Police Station and on enquiry, as it was disclosed that the dispute is civil in nature, 5th respondent advised the 6th respondent to approach the concerned Court. According to the learned Government Pleader, Sub-Inspector of Police categorically denied of calling the petitioner to the Police Station and made him to sit the whole day.

Since complaint made by 6th respondent was closed, it cannot be said that 5th respondent is harassing the petitioner. Writ Petition is accordingly disposed of. However, it is needless to observe that petitioner shall not be called to the Police Station unless crime is registered and only if his presence is required in the process of investigation.
