THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7961 OF 2015 ORDER:
This Criminal Petition is filed by A.13 & A.14 under Section 482 of Cr.P.C. seeking to quash the proceedings in FIR No.78 of 2012 on the file of CID PS, Hyderabad. Admittedly, the petitioners herein have already obtained anticipatory bail and the investigation also proceeded with the investigation. Now it is informed by the learned counsel for the petitioners that the trial Court is insisting for their appearance even though change sheet is not filed before the Court. This Court is of the view that when the investigation is pending, after obtaining bail by the petitioners, the trial Court cannot insist for the presence of the petitioners before it for all hearing dates. The trial Court can issue summons to the accused-petitioners, if any charge sheet is filed by the investigating agency. The concerned police are directed to complete the investigation and file the charge sheet as expeditiously as possible.
With the above observations, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions, if any, pending, shall stand closed.
